General Terms and Conditions of Sale for the Purchase of Event Tickets from 'musicofvienna.com' - Thomas Zettelmayr SP §1. Validity These General Terms and Conditions shall apply to all purchases of admittance tickets to leisure-time events as issued through the agency of musicofvienna.com - Thomas Zettelmayr SP, Blumberggasse 4/3, 1160 Vienna, Austria, VAT-Code ATU49676809, hereinafter musicofvienna.com. By placing an order via the Internet, by telephone, e-mail or fax, the buyer thereby makes an offer to conclude a contract. Such placing of an order shall be deemed to have been fulfilled as of the time of its receipt by musicofvienna.com. The acceptance of the offer to conclude a contract shall take place by means of sending a confirmation of purchase and an order number by e-mail. By means of such purchase confirmation and/or order number the buyer is able to collect the tickets at the ticket office of the event organiser. §2. Prices and Offer All prices given include any applicable levies and pre-sale fees. They do not include any postage and handling fees. The offers will be carefully checked and regularly updated. However, no guarantee can be provided for the completeness or correctness of the offer-related information, or for it being up-to-date. Said information is subject to change, and errors and omissions are excepted. §3. Confirmation of Order/Cancellation The order confirmations issued by musicofvienna.com must be checked immediately. Any noticeable deviations from the order placed must be claimed in the form of a written notice (fax, e-mail) without delay. According to the Distance Selling Act for the provision of leisure services a cancellation of the contract is principally ruled out. However, provided that the event organiser permits cancellation of the tickets, musicofvienna.com will undertake efforts to enable cancellation in accordance with the organiser’s regulations. §4. Liability musicofvienna.com is merely the agent for the admittance tickets and shall not be held liable for any faults on the part of the event organiser, including but not limited to: change of performers and or changes to the programme, postponements or cancellation of the performance. musicofvienna.com is not obliged to inform the buyer of any cancellations/postponements/changes of venue; we shall, however, undertake efforts to inform all buyers of any such changes where possible. In any event we shall not assume any liability for any travel, accommodation, or similar expenses in connection with cancelled or postponed events, or changes of venue in respect of such events. No reimbursement/replacement/compensation can be made for non-used or only partially used tickets (e.g. by latecomers), or for lost, or in any way whatsoever mislaid tickets. §5. Data Protection, Data Transfer Data collected in connection with the purchasing procedure will be kept for accounting purposes and for client files. These data include in detail: billing address, delivery address and tickets ordered. Said data will be dealt with in accordance with the Data Protection Act and the data will be passed on to the event organizer concerned only. Sensitive data will be transferred via SSL, making it unable to be read by third parties. Payments will be made where possible through authorized and certified payment partners. §6. Place of Performance / Place of Jurisdiction These Terms and Conditions are governed by Austrian law. The place of performance shall be Vienna. The place of jurisdiction shall be the applicable court responsible for such matters in Vienna.
